These Terms of Use govern access to and use of our website(s), application(s), APIs, notifications and any information or content appearing therein (collectively, the "Platform"). Please read them carefully.
1. These Terms
- These terms of use govern your use and access to our services, including our website(s), our application(s), our application programming interfaces (APIs), our notifications and any information or content appearing therein (collectively our "Platform").
- By using our Platform, you agree to these terms regardless of whether you are a paying user or a non-paying visitor. If you are using our Platform as a representative of an entity, you are agreeing to these terms on behalf of that entity.
- You should also read our Privacy Policy, which sets out how we collect and use your personal information.

If we need to contact you, we will do so by telephone, email, or post to the details you provided. References to "writing" include email.
3. Changes to These Terms
We may amend these terms from time to time by posting the updated terms on our Platform. If we make material changes, we will notify you before they become effective. Continued use after changes take effect means you agree to be bound by the revised terms.
4. Availability of Our Services
- We continually improve our Platform and may add, change, suspend, or discontinue products, services, features, or functionality. Where reasonably possible, we will give advance notice.
- Some features may be released as “beta”, “preview”, “early access”, or “trial” and may not be as reliable as other features.
- We may limit, restrict, suspend, or terminate use if we believe these terms are breached or the Platform is misused.
- We strive for uptime but do not guarantee uninterrupted or error-free operation. Downtime may occur for maintenance, repairs, upgrades, or failures.
- You are responsible for configuring your systems to access the Platform and for protecting against malware. We do not warrant the Platform is bug- or virus-free.
5. Your Account and Password
- Provide truthful, accurate, and up-to-date registration information and choose a strong password. Keep it confidential.
- Do not share account credentials or allow others to access your account. We may suspend or terminate suspected shared accounts.
- We may disable passwords where we reasonably believe these terms are breached.
- Follow the Acceptable Use Policy.
- You are responsible for all activities under your account unless you report misuse.
6. Use of the Platform
- Comply with the Acceptable Use Policy and all applicable laws, including privacy and intellectual property laws.
- Subject to payment of applicable fees, we grant you a personal, worldwide, royalty-free, non-assignable, non-transferable, non-sublicensable, non-exclusive, revocable licence to access and use the Platform solely as permitted by these terms.
- This licence terminates if you do not comply with these or additional terms we may impose.
- Do not copy, modify, distribute, sell, lease, loan, trade, or otherwise exploit access to the Platform or data on it.
7. Your Rights (Content)
- You retain rights to any information or content you submit, post, or display on or through the Platform ("Your Content").
- By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free licence (with the right to sublicense) to use, process, copy, reproduce, adapt, modify, publish, transmit, display, and distribute such content in any media or through any channels, subject to our Privacy Policy.
- You are responsible for Your Content and consequences of its use by others. We are not liable for use of Your Content or others’ content.
- You warrant Your Content does not infringe third-party rights and that you have necessary rights to grant the above licence.

8. Our Rights
- All IP rights in the Platform and services belong to us or our licensors. You must not reproduce, distribute, or create derivative works from Platform content.
- We may (but need not) review user content and remove content that is offensive, harmful, deceptive, discriminatory, defamatory, misleading, or infringing.
- Our name "E-Bunker Quality Survey LLP" and our marks/logos are trade marks and may not be used without prior written consent.
9. Integrations
We integrate with third-party software. Use of such software is governed by the third party’s terms. We are not responsible for issues or loss arising from third-party software.
10. Feedback
We welcome feedback. You agree we may use, disclose, adopt, and/or modify any feedback you provide in connection with the Platform or our services, without payment. You waive any claims to fees, royalties, or other payments arising from such use.
11. Limitation on Liabilities
- The Platform and services are provided on an "as is" and "as available" basis at your own risk. We make no express or implied warranties, including merchantability, fitness for a particular purpose, or non-infringement.
- We do not warrant information on the Platform is always accurate, complete, or up-to-date; nor that the Platform will be uninterrupted, secure, or error-free.
- To the fullest extent permitted by law, we are not liable for indirect, incidental, special, exemplary, consequential, or punitive damages; or any loss of data, business, opportunities, reputation, profits, or revenues related to the Platform.
- Our aggregate liability, if any, is limited to direct damages arising from gross negligence or wilful misconduct, not exceeding the total fees paid by you in the preceding twelve (12) months.
- Nothing excludes liability that cannot be excluded by law (e.g., fraud or consumer rights that cannot be waived).
12. Your Representation
- The Platform is not intended for minors. By using it, you represent you are an adult with capacity to contract.
- If you use the Platform on behalf of an entity, you represent you have authority to agree to these terms on its behalf.
13. Indemnity
You agree to indemnify and hold our entities harmless against liabilities, damages, claims, costs (including legal fees) and expenses arising from your breach of these terms, your use of the Platform, or any misrepresentation by you. You agree to cooperate fully in the defence or settlement of any claim. Client indemnity for SaaS use covers only direct losses from unauthorised use and excludes indirect or consequential losses.
14. Termination
- These terms continue until terminated by you or us. You may deactivate your account at any time.
- We may suspend or terminate access where we reasonably believe you materially or repeatedly breach these terms; cause real risk of harm or loss; are required by law or authorities; or provision is no longer possible or commercially viable. We will notify you where permitted.
- On termination, these terms end except for Sections 11–18. We may report breaches to law-enforcement and cooperate by disclosing identity and information as required.
15. Entire Agreement
These terms constitute the entire agreement regarding use of the Platform and supersede prior agreements or representations. You acknowledge you have no remedies for statements not set out herein.
16. Other Important Terms
- We may transfer rights and obligations to another organisation. We will inform you. If you do not wish to continue, you may end the contract within one (1) calendar month and we will refund pre-payments for products not provided.
- You may transfer your rights or obligations only with our written consent.
- If any provision is unlawful, the remainder remains in force.
- Delay in enforcement is not a waiver of our rights.

18. Governing Law & Jurisdiction
These terms are governed by and construed in accordance with the laws of the Republic of Singapore. The courts of Singapore have exclusive jurisdiction over disputes arising from or related to these terms.
19. Service Levels (SLA)
- Scope. This Service Level Agreement (“SLA”) describes our service commitments for paid plans on the Platform. It does not apply to free or trial access, which are provided on a best-effort basis only.
- Service availability. We aim for at least 95% uptime per calendar month for core Platform functionality (login, survey creation, survey editing and PDF generation). This uptime target is a good-faith objective and not a guarantee.
- Planned maintenance. From time to time, we may perform planned maintenance that may affect availability. Where reasonably possible, we will schedule such maintenance outside typical business hours and/or provide advance notice via the Platform or email.

Support and response times.
For paid plans, we provide email support during normal business hours (Mon–Fri, excluding
Singapore public holidays). We aim to respond to:
- service-down or critical issues within a commercially reasonable time; and
- general queries and non-critical issues within the next business day.
- Exclusions. This SLA does not apply to downtime or issues caused by: (a) factors outside our reasonable control (for example, internet or network failures); (b) your equipment, systems or third-party services; (c) misuse of the Platform or use in breach of these Terms or the Acceptable Use Policy; or (d) beta / preview features or trial access.
- Service credits and sole remedy. Unless expressly agreed in a separate written contract, we do not provide automatic service credits. Any remedy or goodwill credit for service issues will be at our sole discretion. This SLA does not increase or modify the limitations of liability set out in Section 11 of these Terms.
- Changes to this SLA. We may update this SLA from time to time in accordance with Section 3 (“Changes to These Terms”). Continued use of the Platform after changes take effect constitutes acceptance of the updated SLA.
Acceptable Use Policy
As part of the Terms of Use, you agree not to misuse the Platform or help anyone else to do so. In connection with the Platform, you agree not to:
- Use the Platform for unlawful or unauthorised purposes, or re-sell or commercially exploit data/content from it.
- Re-sell or attempt to benefit in a commercial fashion from any data, content or information available on the Platform.
- Probe, scan, or test vulnerabilities; breach or circumvent security/authentication; exceed service limits; access non-public areas.
- Interfere with users, hosts, or networks (e.g., malware, overloading, flooding, spamming, mail-bombing, or disruptive scripting).
- Reverse engineer or attempt to derive source code (except for open-source components).
- Access, search, or create accounts by means other than publicly supported interfaces; create accounts in bulk; or scrape.
- Send unsolicited communications, promotions, or spam; forge headers; spoof or phish; send altered or deceptive source information.
- Conduct surveys, contests, or pyramid schemes, or promote products/services without authorisation; abuse referrals or promotions.
- Post or share unlawful, obscene, defamatory, abusive, knowingly false, or IP-infringing material.
- Violate these Terms, applicable laws or regulations, or the privacy or rights of others.
